HSC Legal Studies

Writing the HSC Legal Studies Section III option responses

Section III has a question on every option, each with two alternatives. You answer two alternatives, each on a different option: 25 marks each, about 1000 words each, half the paper.

A plan for 25 marks

  • In reading time, choose the alternative where you can name the most law and reach a clear judgement.
  • An introduction that defines the key terms and gives your judgement on effectiveness in one sentence.
  • Three or four body paragraphs, each on one issue or response, with the law you studied as evidence, its strengths and its limits, and a link back to the question.

Effectiveness is the question

Most option questions ask, in some form, how well the law achieves justice. Weigh legal and non-legal responses, say what has changed through law reform, and finish with a judgement you can defend from the evidence you used.

Question 1
In a hypothetical case, the ice dispenser on Mei's new fridge stops working after three weeks, though the fridge still cools normally. One cheap part has failed and can be replaced in a day. Under the Australian Consumer Law, what can Mei do first?
Question 2
What is the only ground for a divorce order under the Family Law Act 1975?

Questions people ask

Can I answer both alternatives on the same option?

No. Your two answers must be on different options.

How should I split my time?

The two option responses are half the marks, so plan for about half the writing time across them.
